General Terms and Conditions of Sale
Please note that these conditions govern the sales, by GALERIE ROBILLARD, of works and other products present on the website www.galerierobillard.com (the Site). These conditions apply to the exclusion of all other conditions.
ARTICLE 1 – THE CUSTOMER
The Customer declares to be a natural person, of at least 18 years old and to have the legal capacity or to hold a parental authorization allowing them to place an order on the Site. When registering the Customer’s personal data in the “my account” section, the customer must ensure the accuracy and completeness of the mandatory data they provide. In the event of an error in the wording of the recipient’s contact details, GALERIE ROBILLARD cannot be held responsible for the impossibility of delivering the product.
The subscription to a contract governed by these general conditions with GALERIE ROBILLARD implies the acceptance, by the Internet user, of all the general conditions, who acknowledges at the same time having taken full knowledge of them. This acceptance will consist in the fact that the user clicks on the button “secure payment with Monetico”. This fact of ticking the box will be deemed to have the same value as a handwritten signature on the part of the user. The user acknowledges the evidentiary value of the automatic registration systems of the publisher of this website and, unless they provide proof to the contrary, they waive the right to contest them in the event of a dispute. The acceptance of these general conditions presupposes on the part of Internet users that they have the necessary legal capacity for this, or have the authorization of a guardian or curator if they are incapable or their legal representative if they are minors.
GALERIE ROBILLARD reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.
ARTICLE 2 – ORDER
The taking of orders on the Site is subject to compliance with the procedure set up by the Company GALERIE ROBILLARD concretized by a succession of different steps that the customer must imperatively follow to validate their order. The Customer will have the possibility, before definitively validating his order, to check the details of it and its total price, and to correct any errors, before confirming it to express their acceptance.
Any order confirmed by the Customer is worth a sales contract and acceptance of all the stipulations of these general conditions of sale. These may not be modified by contrary stipulations of the Customer on the purchase orders, regardless of when they could have been brought to the attention of GALERIE ROBILLARD.
A confirmation e-mail summarizing the order (products, price, quantity…) will be sent to the Customer. For this purpose, the Customer formally accepts the use of their e-mail for the confirmation by the Company GALERIE ROBILLARD and MONETICO of the content of his order. The Customer is therefore also required to provide a valid e-mail address when registering.
ARTICLE 3 – PRICES
The prices of our products are indicated in euros all taxes included excluding participation in processing and shipping costs. Shipping costs are calculated when the Customer place their order and before they proceed to payment. All these prices are communicated in euros.
In case of order to a country other than metropolitan France the Customer is the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of GALERIE ROBILLARD. They will be at the Customer’s expense and are their sole responsibility both in terms of declarations and payments to the competent authorities and/or bodies in your country. We advise the Customer to inquire about these aspects with their local authorities.
All orders regardless of their origin are payable in euros. GALERIE ROBILLARD reserves the right to modify its prices at any time, but the products will be invoiced based on the rates in force at the time of registration of orders subject to their availability.
The products remain the property of GALERIE ROBILLARD until full payment of the price indicated.
ARTICLE 4 – VALIDATION
When the Customer clicks on the “secure payment with Monetico” button after the order process, they declare that they accept it and all of these General Terms and Conditions of Sale fully and without reservation.
The data recorded by www.galerierobillard.com constitute proof of all transactions made by GALERIE ROBILLARD and its customers.
The data recorded by the Monetico payment system constitutes proof of financial transactions.
ARTICLE 5 – AVAILABILITY
Our product offers are offered within the limits of available stocks.
ARTICLE 6 – DELIVERY
The products are delivered to the delivery address the Customer indicated during the ordering process.
The Gallery uses different shipping services. The shipment of the works is made upon full receipt of payment and shipping costs which are the sole responsibility of the Customer. The shipping time, taking into account the preparation time, is a maximum of 5 working days for original works (15 working days maximum for limited prints). If the work belongs to an ongoing exhibition, it will be sent at the closing of the exhibition. To this will be added the delivery time of the carrier.
Galerie ROBILLARD undertakes to pay particular attention to the packaging and sending of the works.
The company GALERIE ROBILLARD can not be held responsible for the consequences due to a delay in delivery not being of its own making.
In case of damaged package (already opened, missing product(s)…), the Customer undertakes to notify the carrier and the Company GALERIE ROBILLARD, by any means, of any reservations within 24 hours of receipt of the product.
ARTICLE 7 – PAYMENT AND SECURITY
Payment for the purchases is made through the secure payment service provided by Monetico.
All payment details are the responsibility of the Monetico secure service.
Other means of payment are possible (check, cash, bank transfer) but do not allow the Customer to benefit from the automatic purchase on our Site. Please contact us to purchase a work using these other payment methods.
ARTICLE 8 – WITHDRAWAL PERIOD
The Customer has a period of 14 days from receipt of his order to inform GALERIE ROBILLARD of their wish to return the work or works that will not suit them. Only the price of the purchased work(s) and the shipping costs will be reimbursed, the return costs remaining at their expense.
Returns must be made at the latest within 14 days of sending their decision to withdraw, to the following address: GALERIE ROBILLARD, 106 rue de la Folie Méricourt, 75011 Paris, France, in good condition and accompanied by a copy of the invoice.
The refund will be made by crediting the customer’s bank account or via Monetico, after receipt of the returned work(s).
Apart from these conditions, no other returns or exchanges are possible.

ARTICLE 10 – INTELLECTUAL PROPERTY
All texts, comments, works, illustrations and images reproduced on the GALERIE ROBILLARD website are reserved under copyright as well as intellectual property and for the whole world. As such, and in accordance with the provisions of the Intellectual Property Code, only use for private use is authorized, subject to different or even more restrictive provisions of the Intellectual Property Code. Any other use constitutes counterfeiting and is punishable under the Intellectual Property without the prior authorization of GALERIE ROBILLARD. Any total or partial reproduction of the GALERIE ROBILLARD catalogue is strictly prohibited.
ARTICLE 11 – LIABILITY
The products offered comply with the French legislation in force. It is the Customer’s responsibility to check with the local authorities about the possibilities of importing or using the products or services they plan to order. The photographs and texts reproduced and illustrating the products presented may contain minor deviations from the original works. Consequently, the responsibility of GALERIE ROBILLARD can not be engaged on this fact. GALERIE ROBILLARD cannot be held responsible for the non-performance of the contract concluded in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike including postal services and means of transport and / or communications, flood, fire.
GALERIE ROBILLARD will not incur any liability for any indirect damage due to the present, operating loss, loss of profit, loss of opportunity, damage, or costs.
If, in the performance of the obligations incumbent on it, the responsibility of GALERIE ROBILLARD is engaged, the Customer may only claim damages that may not exceed the total amount paid by the Customer in payment of the order in question.

This contract is subject to French law. The language of this contract is translated from the French language. In case of dispute, the French courts will have sole jurisdiction.
ARTICLE 12 – PERSONAL INFORMATION
GALERIE ROBILLARD undertakes not to disclose to third parties the information the Customer provides. These are confidential. They will only be used by its internal services for the processing of the order and to strengthen and personalize the communication and the cultural and product offer reserved for galerie ROBILLARD’s customers, in particular through the newsletters of GALERIE ROBILLARD to which the Customer will be subscribed as well as part of the personalization of the site according to your interests.
In accordance with the provisions of the Law of 6 January 1978 relating to data processing, files and freedoms, amended by the Law of 6 August 2004, customers have a right of access, rectification to personal data concerning them with GALERIE ROBILLARD.
